The administration of a Home Owners Association/Section 21 Complex is similar to sectional title in that some of the same conditions apply to residents, such as common property, conduct rules and the payment of levies, however the monthly payment for council services remains the responsibility of the owners.

The "Act" refers to the Sectional Title Act 95 of 1986 and has been a fact of life in South Africa for almost twenty years.  It is a form of ownership where a number of people can simultaneously own a piece of land on which dwellings are built, while each of these people individually owns a unit or flat on the common property.

It is advisable that the trustees obtain a copy of the Sectional Title Act, there are also a number of other publications that are recommended for reference purposes.  One of these is "Demystifying Sectional Title" written by Marina Contas and Karen Bleijs, which is an excellent book written in simple language.  We have used information from this book in the development of this website and would like to give acknowledgement to the authors.
